1 Basic Provisions
The following terms and conditions apply to contracts you enter into with us (Beta Bayern) through the website https://beta-bayern.de/ .Unless otherwise agreed, we object to any inclusion of your own terms and conditions.
For the purposes of these terms, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly not related to their commercial or independent professional activities. An entrepreneur is any natural or legal person or a legally responsible partnership that acts in the exercise of their independent professional or commercial activities when concluding a legal transaction.
2 Formation of the Contract
The subject of the contract is the sale of goods.
By placing the respective product on our website, we make you a binding offer to conclude a contract under the conditions specified in the product description via the online shopping cart system.

The goods intended for purchase are placed in the “shopping cart.” You can access the shopping cart and make changes at any time via the corresponding button in the navigation bar.
After clicking the button “Checkout” or “Proceed to Order” and entering personal data as well as payment and shipping conditions, the order details are displayed as an order overview.
If you use an instant payment system (e.g., PayPal, Amazon Pay, Sofort, giropay), you will either be directed to the order overview page in our online shop or to the provider’s website of the instant payment system.
After being redirected to the instant payment system provider, you make the necessary selection or input your data. The order details are displayed as an order overview either on the provider’s website or after you have been redirected back to our online shop.
Before submitting the order, you can review, modify (also via the “back” function of the internet browser), or cancel the order.
By submitting the order via the respective button (“place order,” “buy,” “purchase,” etc.), you declare the legally binding acceptance of the offer, which concludes the contract.

3 Special Agreements Regarding Payment Methods
Payment via SOFORT / Sofortüberweisung
When selecting the payment method Sofort / Sofortüberweisung, payment processing is done through the payment service provider Sofort GmbH, a company of Klarna Group. You must have an online banking account enabled for this service. During the payment process, you must legitimize yourself and confirm the payment instruction to SOFORT. 4 Right of Retention, Retention of Title
You can only exercise a right of retention if it concerns claims arising from the same contractual relationship. The goods remain our property until full payment of the purchase price.
5 Warranty
Statutory warranty rights apply. As a consumer, you are requested to check the goods immediately upon delivery for completeness, obvious defects, and transport damage and to notify us and the carrier promptly. Failure to do so has no effect on your statutory warranty claims. Any deviation from the objective requirements of the goods is only agreed upon if you have been informed before submitting the contract declaration and the deviation has been expressly and separately agreed upon by the parties.
6 Choice of Law, Place of Fulfillment, Jurisdiction
German law applies. For consumers, this choice of law only applies to the extent that it does not deprive the consumer of mandatory protection under the law of the state of the consumer’s habitual residence. The place of fulfillment for all services and jurisdiction is our location, provided you are not a consumer but a merchant, a legal entity under public law, or a special fund under public law. The same applies if you have no general jurisdiction in Germany or the EU or your residence or habitual abode is unknown at the time of filing the lawsuit. The authority to also call the court at another statutory place of jurisdiction remains unaffected. The provisions of the UN Convention on Contracts for the International Sale of Goods expressly do not apply.

3- Contract Language, Contract Text Storage
3.1. The contract language is German.
3.2. The complete contract text is not stored by us. Before submitting the order via the online shopping cart system, the contract data can be printed out or electronically saved. After receiving the order, the order data, legally required information for distance contracts, and the General Terms and Conditions will be sent to you again by email.

6- Prices and Payment Terms
6.1. The prices listed in the respective offers and the shipping costs represent total prices. They include all price components, including all applicable taxes.
6.2. The incurred shipping costs are not included in the purchase price. They can be accessed via a correspondingly labeled button on our website or in the respective offer, are shown separately during the order process, and must be borne by you unless free shipping is promised.
6.3. Any costs incurred for money transfer (transfer or exchange rate fees of the credit institutions) are to be borne by you in cases where the delivery is made to an EU member state, but the payment was initiated outside the European Union.

6.5. Unless otherwise stated for the individual payment methods, the payment claims arising from the concluded contract are immediately due for payment.
7- Delivery Terms

7.2. If you are a consumer, it is legally regulated that the risk of accidental loss and accidental deterioration of the sold goods during shipment only passes to you upon delivery, regardless of whether the shipment is insured or uninsured. This does not apply if you have independently commissioned a transport company not named by the entrepreneur or a person otherwise designated to carry out the shipment.
